Re: DNC’s Use of “Fahrenheit 9/11” Footage in “100” Ad
Dear Chairman Dean:
I write regarding the Democratic National Committee’s (DNC) advertisement attacking Senator John McCain titled “100,” which was released on Sunday, April 27, 2008.As you are already aware, and as has been widely reported, the DNC’s ad is troubling for at least two reasons. First, its message is factually false; the DNC is deliberately misleading American voters. Second, it constitutes an illegal excessive in-kind contribution from the DNC to its presidential candidates. Now the Republican National Committee has learned that the ad features footage from Michael Moore’s 2004 conspiracy theory, “Fahrenheit 9/11.” read more »

Here is video of former Oklahoma Gov. Frank Keating - a leading supporter of John McCain - talking with Fox News about the reaction of Howard Dean and the Democratic National Committee to a recent John McCain ad that points out his military service as a POW. Dean calls that being "an opportunist."
Dean just hates the fact John McCain actually has a record of service and valor to run on, as opposed to the two candidates for the Dems whose records look mighty slim next to McCain.

In reference to John McCains integrity,Howard Dean says, "He doesn't have any"".
Update From Mcain Cmpaign:Updated 6:11 p.m. with response from the McCain campaign: "John McCain is a man of integrity who will run on his record. Senators Clinton and Obama should denounce this desperate, personal smear campaign Howard Dean and the leaders of their party seem intent on running," the McCain campaign said in a statement to CNN.

Here is a letter sent to the FEC on Febuary 28th on behalf of John McCain. Notice the reference to Howard Dean using much the same "procedures" to opt out of public financing.
Here is Box D of the FEC form that the McCain Campaign submitted:

Notice the disclaimer .."Excluding certifications for Federal Matching Funds"
